1. Introduction

Welcome to Attested Call. These Terms of Service ("Terms") govern your use of the Attested Call application and related services ("Service") provided by VDR Tech LLC ("we," "us," "our"), a company registered in Masdar City Free Zone, Abu Dhabi, United Arab Emirates.

By accessing or using Attested Call, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

2.1 What Attested Call Does

Attested Call provides cryptographic identity verification for voice calls and messages. When you make a call, Attested Call sends a signed beacon to the recipient, allowing them to verify that the call is genuinely from you.

2.2 What Attested Call Does NOT Do

Attested Call is not a communications service. We do not:

Provide phone calls, messaging, or any communication channel
Access, record, intercept, or store the content of your calls
Replace or modify your phone carrier or messaging apps

We provide verification only. The actual call travels through your existing phone network or messaging platform.

2.3 Beta Service

Attested Call is currently in beta. This means:

The Service is provided for testing and evaluation purposes
Features may change, be added, or be removed without notice
The Service may be unavailable, interrupted, or discontinued at any time
We make no guarantees regarding uptime, reliability, or performance

3. Beta License

3.1 Grant of License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Attested Call during the beta period.

3.2 No Warranties

THE BETA SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We disclaim all warranties, including but not limited to:

Merchantability
Fitness for a particular purpose
Non-infringement
Reliability or availability
Accuracy of verification results

3.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VDR TECH LLC SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Any damages arising from reliance on verification results
Any damages exceeding the amount you paid us in the 12 months preceding the claim (which, during the free beta period, is zero)

3.4 Assumption of Risk

You acknowledge that:

Verification technology is not infallible
You should not rely solely on Attested Call for high-stakes decisions
We are not responsible for actions you take based on verification results
Phone calls may still be fraudulent even if unverified by our system (the caller may simply not use Attested Call)

4. Transition to Paid Service

4.1 Right to Change Terms

We reserve the right, at our sole discretion, to:

Introduce paid subscription tiers
Change pricing at any time
Modify, limit, or remove features
Convert the Service from free to paid
Change these Terms with reasonable notice

4.2 Notice of Changes

If we introduce paid tiers or make material changes to the Service:

We will notify you at least 30 days in advance via email or in-app notification
You may choose to accept the new terms and continue using the Service
You may decline and discontinue use of the Service
Continued use after the effective date constitutes acceptance

4.3 Founder and Early Adopter Benefits

If you are granted "Founder" status or other early adopter benefits during the beta period, such benefits:

Are granted at our discretion
May be modified or revoked as described in these Terms
Are subject to your continued compliance with these Terms
May be conditioned on continued use (e.g., maintaining active status)

We will honor stated Founder benefits (e.g., "lifetime free access") subject to your compliance with these Terms and continued availability of the Service.

5. Account and Registration

5.1 Account Creation

To use Attested Call, you must:

Register using Google Sign-In, Apple Sign-In, or another supported method
Provide accurate and complete registration information
Verify your email address and phone number
Be at least the age of digital consent in your jurisdiction, or have parental/guardian consent

5.2 Account Security

You are responsible for:

Maintaining the security of your account
All activity that occurs under your account
Notifying us immediately of any unauthorized access

5.3 Accuracy of Information

You represent that all information you provide is accurate, current, and complete. We may suspend or terminate accounts with false information.

6. Invitations and Referrals

6.1 Invitation System

You may receive invitations to share with others. Invitations are:

Personal to you and may not be sold or traded
Subject to expiration (typically 90 days)
Granted at our discretion and may be adjusted or revoked

6.2 Referral Benefits

Any referral bonuses (e.g., additional invitations, credits, badges) are:

Granted at our discretion
Subject to verification of legitimate referrals
Revocable in cases of abuse or fraud

6.3 Prohibited Referral Practices

You may not:

Create fake accounts to generate referrals
Use bots, scripts, or automated means to send invitations
Offer monetary incentives for referrals without our approval
Engage in any deceptive or fraudulent referral activity

7. Acceptable Use

7.1 Permitted Use

You may use Attested Call for its intended purpose: verifying your identity to call recipients and verifying the identity of callers to you.

7.2 Prohibited Conduct

You may not use Attested Call to:

Illegal Activity

Violate any applicable law, regulation, or legal obligation
Facilitate fraud, money laundering, or other financial crimes
Impersonate another person or entity
Infringe intellectual property rights

Harmful Conduct

Harass, stalk, threaten, or intimidate others
Facilitate or coordinate harmful activity
Distribute malware or attempt to compromise the Service
Circumvent security measures or access restrictions

Service Abuse

Reverse engineer, decompile, or disassemble the application
Use the Service in a manner that degrades performance for others
Resell, sublicense, or commercialize access without authorization
Create derivative works based on the Service

Misrepresentation

Use verification to deceive or mislead recipients
Falsely claim association with individuals or organizations
Manipulate verification results or badges

7.3 Enforcement

We may, at our sole discretion:

Investigate suspected violations
Remove or restrict content or functionality
Suspend or terminate accounts
Report illegal activity to law enforcement
Pursue legal remedies

8. Intellectual Property

8.1 Our Property

Attested Call, including all software, designs, trademarks, and content, is owned by VDR Tech LLC. You receive no ownership rights by using the Service.

8.2 Your Content

You retain ownership of any content you provide (e.g., profile information). By providing content, you grant us a license to use it as necessary to provide the Service.

8.3 Feedback

If you provide feedback, suggestions, or ideas, we may use them without obligation to you.

9. Third-Party Services

Attested Call integrates with third-party services (phone carriers, messaging apps, device operating systems). We are not responsible for:

The availability or operation of third-party services
Changes to third-party services that affect Attested Call
Third-party terms, policies, or practices

Your use of third-party services is governed by their respective terms.

10. Termination

10.1 Termination by You

You may stop using Attested Call at any time. To delete your account, contact support@attestedcall.com or use the in-app account deletion feature.

10.2 Termination by Us

We may suspend or terminate your account at any time, for any reason, with or without notice, including but not limited to:

Violation of these Terms
Suspected fraud or abuse
Extended inactivity
Discontinuation of the Service

10.3 Effect of Termination

Upon termination:

Your license to use the Service ends immediately
Your account and associated data may be deleted
You lose access to any invitations, badges, or benefits
Provisions that by their nature should survive termination will survive (e.g., limitation of liability, governing law)

11. Service Modifications and Discontinuation

11.1 Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

11.2 Discontinuation

If we discontinue the Service entirely:

We will provide at least 30 days' notice where practicable
We will make reasonable efforts to allow data export
We will have no liability for discontinuation

12. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless VDR Tech LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Your content or conduct

13. Dispute Resolution

13.1 Informal Resolution

Before initiating formal proceedings, you agree to contact us at legal@attestedcall.com and attempt to resolve the dispute informally for at least 30 days.

13.2 Governing Law

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict of law principles.

13.3 Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Abu Dhabi, United Arab Emirates, including the courts of Masdar City Free Zone where applicable.

13.4 Class Action Waiver

To the extent permitted by law, you waive any right to participate in a class action lawsuit or class-wide arbitration against VDR Tech LLC.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and VDR Tech LLC regarding the Service.

14.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

14.3 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

14.4 Assignment

You may not assign your rights under these Terms. We may assign our rights to any affiliate or successor.

14.5 No Agency

Nothing in these Terms creates any agency, partnership, or employment relationship.

14.6 Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control.

15. Marketing and Communications

15.1 Service Communications

By using Attested Call, you agree to receive service-related communications, including:

License and account notifications
Security alerts
Service updates and changes
Legal notices

You cannot opt out of service communications while using the Service.

15.2 Marketing Communications

With your consent, we may send you marketing communications about:

Attested Call features, updates, and promotions
Other products and services from VDR Tech LLC
Products and services from our partners

You may opt out of marketing communications at any time by:

Clicking "unsubscribe" in any marketing email
Emailing privacy@attestedcall.com
Adjusting settings in the app

15.3 Consent Scope

If you consent to marketing communications, you consent to receive communications about all VDR Tech LLC products and services, not just Attested Call, as well as communications from our partners where you have specifically opted in.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

Email to your registered address
In-app notification
Posting the updated Terms on our website

Continued use of Attested Call after the effective date of changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.
